La SMPDD et la DAPR passent au scanner des impacts de la gestion de la crise sanitaire sur des droits de l’homme en milieu carcéral

La SMPDD (Solidarité Mondiale pour les Personnes Démunies et les Détenus) et la DAPR ( la Direction de l’Administration Pénitentiaire et de la Réinsertion) en collaboration avec le ministère des droits de l’homme, de la formation à la citoyenneté et des relations avec les institutions de la république, ont organisé ce 10 décembre un atelier, dans le cadre de la 72ème journée internationale des droits de l’homme, sur le thème: « Les droits de l’homme à l’épreuve de la gestion de la crise sanitaire dans les lieux de détention au Togo ».

Cette initiative vise à permettre une analyse des impacts de la gestion de la crise sanitaire sur l’effectivité des droits de l’homme dans les lieux de détention, d’évaluer l’impact de la gestion de la crise sanitaire sur le fonctionnement des diverses administrations de la chaîne pénale, de relever les défis rencontrés par les acteurs de la chaîne pénale dans le contexte de la crise sanitaire en matière du respect des droits de l’homme, et d’élaborer un rapport conjoint comprenant des recommandations succinctes d’amélioration de la gestion des personnes placées sous-main de justice dans un contexte de crise sanitaire.
Les participants venus de toutes les maisons carcérales du pays ont évalué l’impact de la gestion de la crise sanitaire sur le fonctionnement des diverses administrations de la chaîne pénale. Ils ont mis le doigt sur les défis qui se posent aux différents acteurs de la chaîne pénale eu égard au respect des droits de l’homme dans un contexte de crise sanitaire et ont par la même occasion établi un rapport conjoint comprenant des recommandations succinctes d’amélioration de la gestion des personnes placées sous-main de justice dans un contexte de crise sanitaire.
Les discussions ont porté sur plusieurs thématiques dont « La crise sanitaire et les défis rencontrés par les OPJ dans l’exercice de leur fonction », par un représentant des forces de sécurité et de défense, « La crise sanitaire et le fonctionnement de la justice pénale au Togo », par un magistrat, « Gestion de la crise sanitaire liée au Covid- 19 en milieu carcéral » par le représentant de la CNGR, « Impact de la crise sanitaire sur la gestion des détenus » par le représentant de la DAPR et « Les droits de l’homme dans les lieux de détention dans le contexte de la crise sanitaire », par le représentant de la CNDH.
Une situation analysée comme porteuse de risques pour le respect de la dignité et des droits fondamentaux des personnes privées de liberté : la promiscuité et le risque accru de contagion qu’elle entraîne, la difficulté de maintenir les relations avec les proches, la suspension de l’essentiel des activités et les détentions provisoires dans les commissariats et gendarmeries ont accru les contraintes pesant sur ces personnes.
C’est donc un atelier de sensibilisation des agents des forces de l’ordre et de sécurité, des organisations de défense des droits de l’homme (ODDH) et des professionnels des médias sur la problématique de l’état d’urgence sanitaire et le respect des libertés fondamentales.

La SMPDD dans son rôle de promotion et de défense des droits de l’homme souhaite collaborer avec les acteurs de la chaîne pénale en particulier l’administration pénitentiaire et de la réinsertion pour attirer leur attention sur le respect des droits de l’homme dans l’application des mesures de prévention contre la pandémie du Covid19 dans les lieux de détention.
