Le contrôle judiciaire, de quoi s’agit-il ? Agbéyomé Kodjo, le leader du MPDD, et trois de ses collaborateurs au sein de la dynamique Kpodzro ont été placés vendredi soir sous contrôle judiciaire, au terme de deux jours d’audition pour eux tous et de 72 heures de garde à vue pour Agbéyomé, le candidat malheureux à la dernière présidentielle du 22 février. En termes juridiques, qu’est-ce au juste le contrôle judiciaire ?
Pour répondre à la question, il conviendrait de répondre préalablement à trois sous questions à savoir : Qu’est-ce que le contrôle judiciaire ? Quelles conséquences pour la personne concernée ? Que se passe-t-il en cas de non-respect des obligations ?
Le contrôle judiciaire est, en effet, une mesure qui peut être prise par le juge à l’encontre des personnes mises en examen ou en attente de leur procès. Il est bien entendu une mesure restrictive de liberté. Bref, c’est une alternative à la détention provisoire abondante au Togo ou le bracelet électronique, une pratique pas connue chez nous.
La mesure de contrôle judiciaire est une prérogative du juge, elle est, et doit être toujours décidée par un juge. L’avis du procureur est parfois sollicité.
Le contrôle judiciaire étant une mesure de restriction des libertés, la liberté de déplacement est principalement restreinte. Une personne placée sous contrôle judiciaire est aussi soumise à une série d’interdictions et d’obligations.

Le Code de procédure pénale togolais décrit toutes les mesures qui peuvent être prises dans le cadre d’un contrôle judiciaire. Nous pouvons citer entre autres : interdiction de sortir des limites territoriales fixées par le juge ; interdiction de s’absenter de son domicile ou de la résidence fixée par le juge, sauf pour des motifs ou dans des conditions précisées par le juge ; obligation d’informer le juge des déplacements en dehors de la zone territoriale ; obligation de se présenter à intervalle régulier auprès de certains services ; interdiction de rencontrer certaines personnes, etc.
En cas de non-respect d’une ou plusieurs obligations liées au contrôle judiciaire, le juge d’instruction a le pouvoir d’établir un mandat d’arrêt ou un mandat d’amener. Il a également la possibilité de décider de placer la personne en détention provisoire.
Le contrôle judiciaire peut durer pendant toute la phase de l’instruction ou jusqu’à la comparution de la personne devant le tribunal.
